10ngah Terms and Conditions

These Terms and Conditions of Service (“Terms of Service”) govern your membership on 10ngah.com and 10ngahTaste.com, and their associated mobile sites (the “10ngah Sites” or the “Sites”) and your purchases and use of products and services available through the 10ngah Sites. The 10ngah Sites are operated by 10nga, Inc. and/or its subsidiaries and affiliates (collectively, “10ngah”). Your use of the 10ngah Sites and these terms are also governed by the Website Terms of Use (“Terms of Use”), which are incorporated herein by reference. www.10ngah.com/company/websiteterms

By establishing membership on the 10ngah Sites, or purchasing or using products or services through the 10ngah Sites, you acknowledge and agree as follows:

  1. GENERAL

These Terms of Service have been executed and delivered by you and constitute a valid and binding agreement between you and 10ngah, enforceable against you in accordance with their terms. You represent that you are (1) at least 18 years of age, (2) of legal age to form a binding contract, and (3) not a person barred from receiving services under the laws of the United States or other applicable jurisdiction.

You shall establish and use your membership on the 10ngah Sites, and purchase and use the products and services available through the 10ngah Sites, in strict compliance with these Terms of Service and all applicable laws, rules and regulations (collectively, “Laws”). All calls, emails and other communications between you and 10ngah may be recorded.

Membership of 10ngah’s affiliate site 10ngahcity.com requires acknowledgement of its own Terms of Service, www.10ngahcity.com/company/termsOfUse. By subsequently using this sites, or any sites acquired by 10ngah, you agree to abide by each of those terms and conditions of service.

  1. PRIVACY NOTICE

A copy of the Privacy Notice that applies to the collection, use, disclosure and other processing of personal information by 10ngah is located at www.10ngah.com/company/privacy. You consent to any personal information we may obtain about you (either via the 10ngah Sites, by email, telephone or any other means) being collected, stored and otherwise processed in accordance with the terms of the Privacy Notice. 10ngah may update its Privacy Notice from time to time, in its sole discretion, and post an updated version of the notice at the website address provided above.

  1. 10NGAH MEMBERSHIP

  • Establishing a Membership

You may establish membership on the 10ngah Sites. At a minimum, enrollment requires you to (1) indicate agreement to these Terms of Service, (2) provide contact information and identification details, and (3) submit any other form of authentication required as part of the enrollment process, in 10ngah’s sole discretion. You agree to accept responsibility for all activities that occur under your account or password. You are responsible for maintaining the confidentiality of your account and password, and for restricting access to your account. We encourage you to review our Information Security Policy for information about some of the measures you may take to help protect your account, but we cannot guarantee that implementing such measures will ensure the security of the account or your information.

  • Use of Membership

You shall not use your 10ngah membership for any purpose competitive to 10ngah. You will notify 10ngah immediately by emailing support@10ngah.com of any unauthorized use of your 10ngah membership or the 10ngah Sites known to you, whether by you or a third party.

  • Membership Termination

You may cancel your 10ngah membership at any time by contacting 10ngah customer support as specified on the “Contact Us” page on the 10ngah Sites. 10ngah may terminate your membership and refuse any and all current or future use of the 10ngah Sites or other services, or any portion thereof, (1) in order to comply with applicable Law, (2) if you provide any information that 10ngah determines, in its sole discretion, to be untrue, inaccurate, not current or incomplete (or if the information becomes untrue, inaccurate, not current or incomplete), (3) if 10ngah determines, in its sole discretion, that you are using your 10ngah membership in a manner not permitted by these Terms of Service or the Terms of Use, or (4) in other circumstances, as 10ngah deems appropriate in its sole discretion. Please note that termination by you or 10ngah of your 10ngah membership may result in the termination of your memberships in 10ngah’s affiliated websites.

  1. PURCHASES

  • Order Processing

10ngah may, in its sole discretion, choose to not process or to cancel your order in certain circumstances. This may occur, for example, when the product or service you wish to purchase is out of stock or has been mispriced, we suspect the request is fraudulent, or in other circumstances 10ngah deems appropriate in its sole discretion. 10ngah also reserves the right, in its sole discretion, to take steps to verify your identity to process your order. 10ngah will either not charge you or refund the charges for orders that we do not process or cancel.

  • Return Policy

10ngah accepts returns on certain merchandise on a case-by-case basis. For 10ngah‘s Return Policy, which may change from time to time, please click here.

We reserve the right to immediately cancel any warranties and will also report those threats to the relevant authorities.   • Product and Service Descriptions

10ngah attempts to provide accurate descriptions of products and services on the 10ngah Sites. 10ngah does not warrant, however, that the descriptions are accurate, complete, reliable, current or error-free. If a product or service offered on the 10ngah Sites is not as described, your sole remedy is to return the item, as specified in these Terms & Conditions.

  • Pricing Information

10ngah strives to provide accurate pricing information regarding the products and services available on the 10ngah Sites. We cannot, however, insure against pricing errors. 10ngah reserves the right, at its sole discretion, to not process or to cancel any orders placed for a product or service whose price was incorrectly posted on the site as a result of an error. If this occurs, 10ngah will notify you by email. In addition, 10ngah reserves the right, at its sole discretion, to correct any error in the stated full retail price.

  • Product and Service Availability

The 10ngah Sites may contain information regarding the availability of merchandise. This information can be used to estimate the likelihood that an item will be shipped immediately after you place your order. Unfortunately, 10ngah cannot guarantee that an item listed as “in stock” will actually ship right away, as inventory can change significantly from day-to-day. In rare cases, a product or service offering may be in stock when a customer places the order, and sold out by the time 10ngah attempts to process the order. Should this happen, 10ngah will notify you by email. Service offerings that are out-of-stock generally are no longer available. If 10ngah determines that a product or service you wish to purchase is no longer available, the item will be cancelled from your order. 10ngah will notify you by email and delete the item from the 10ngah Sites.

  • Shipping and Tax

Click www.10ngah.com/support/shipping for our policy regarding shipping and tax, which may change from time to time.

  • Alcoholic Beverages

You must be at least 21 years of age to purchase alcoholic beverages. In addition, due to state restrictions and our merchants’ licenses, alcoholic beverages may not always be shipped to all states in the U.S. or outside the U.S. Please refer to the sale page or product detail page on the 10ngah Sites for information on what states are permitted for specific items. If you provide a shipping address that is not in one of these states, 10ngah will not process your order. We will not ship alcoholic beverages outside the U.S. Quantity limits may apply in some states. Your order may be reduced or held to comply with state restrictions. Taxes collected are collected on behalf of the seller of record.

  1. REFERRAL CREDIT PROGRAM

On certain of its Sites, 10ngah may offer members the ability to earn credits toward future purchases on the 10ngah Sites when they invite friends to become members of a 10ngah Site and those friends make a qualifying purchase within six (6) months of the invitation sent through an authorized 10ngah invitation channel (eg. an invitation sent through 10ngah's website, Facebook or another social media channel supported by 10ngah). You may only earn credits via 10ngah’s authorized member invite mechanisms. Referrals outside of 10ngah authorized channels will not result in any referral credit. You understand that referral credits are not transferable, may not be auctioned, bartered or sold, may not be pooled with other members, and expires six (6) months after issuance. You will only receive credit for the first qualifying purchase made by a friend who makes his or her first purchase on the 10ngah Sites as a result of an invite from you via a 10ngah authorized channel. If your friend does not follow the directions in the invite email or other valid invite mechanism to accept the invitation, you may not receive credit, and 10ngah will have no liability to you for your friend’s failure to follow directions.

You agree that having multiple 10ngah accounts is a violation of these Terms and Conditions and that sending invites to alternate email addresses or accounts or otherwise attempting to circumvent 10ngah 's Referral program system may, without limiting any other 10ngah rights or remedies, result in forfeiture of your membership and all Referral credits in your account. 10ngah reserves the right to void Referrals and credits earned if we suspect that the Referrals or credits were earned in a fraudulent manner, in a manner that violates these Terms and Conditions or in a manner otherwise not intended by 10ngah. You must not conduct your own promotion in connection with our Referral credit program. You may not engage in any promotional, marketing, or other advertising activities on behalf of 10ngah, including by using any trademarks of 10ngah. 

Credits will appear in your account within approximately 24 hours after one of your qualifying invitees makes his or her qualifying purchase and that purchase is shipped. Purchase of a Gift Card is not a qualifying purchase. Credits earned via 10ngah may only be used on the 10ngah Sites or 10ngahcity.com and may not be used toward the purchase of a Gift Card or on any other website affiliated with 10ngah.

The referral credit program is void where prohibited by law. 10ngah reserves the right to modify or terminate the referral credit program at any time, although credits accrued shall be valid for one year from the date of posting. Should there be any tax liability for the accumulation and/or use of credits, such taxes are the sole responsibility of the participant. You understand that your account may not accurately reflect the credits you have actually earned. 10ngah will have no liability for any errors displayed in your account.

  1. PAYMENTS AND GIFT CARDS

Gift Cards may be purchased by clicking here.  Gift Cards and their use, including provisions regarding loss, are subject to the Gift Card Terms and Conditions located here, as well as the Terms of Use and Privacy Notice. email support@10ngah.com. Customer agrees to only remit the payment they selected when making a order they cannot amend payment at will. 10ngah.com reverses the right to cancel a order immediately if merchant selling product decides to reject selected payment. 10ngah.com reverses the right to reject payment if they feel payment is illegal. All payments are pegged to the USD and 10ngah.com will utilize Barclay's Daily Exchange rate for conversion to Rands Plus Margin fee of 5 percent. User agrees that all payments might not be accepted by merchant and user agrees to remit payment to 10ngah.com only in the form they choice when they made the order. User will pay for order first before exchange of goods. Immediately following exchange of goods user cannot demand payment back from courier, user must reach out formally to 10ngah.com for a refund or exchange; if, the situation warrants conditions stated in our delivery and return policy. 

  1. NUTRITIONAL INFORMATION

To the extent required by law, 10ngah posts on each relevant product web page on the 10ngah Sites for any food products (1) the nutritional information regarding the product, and (2) the product’s expiration date.

  1. ENTIRE AGREEMENT

These Terms of Service constitute the entire agreement of between you and 10ngah regarding the specific matters herein, and all prior agreements, letters, proposals, discussions and other documents regarding the matters herein are superseded and merged into these Terms of Service. In the event there is a conflict between these Terms of Service and the Terms of Use with respect to the matters herein, these Terms of Service will control.

  1. SEVERABILITY

If any provision of these Terms of Service enforceability of the remaining provisions shall not in any way be affected or impaired thereby, and such provision shall be deemed to be restated to reflect the parties’ original intentions as nearly as possible in accordance with applicable laws.

  1. MODIFICATION OF TERMS OF SERVICE

You acknowledge and agree that 10ngah may, in its sole discretion, modify, add or remove any portion of these Terms of Service at any time and in any manner, including the terms of 10ngah membership, by posting revised Terms of Service on the Site. You may not amend or modify these Terms of Service under any circumstances. The current version of these Terms of Service is available at www.10ngah.com/company/termsOfUse. It is your responsibility to check periodically for any changes we make to the Terms of Service. Your continued use of this Site after any changes to the Terms of Service means you accept the changes.

  1. EFFECT OF TERMINATION/SURVIVAL OF SELECTED PROVISIONS

Notwithstanding the expiration or earlier termination of your 10ngah membership, or any general legal principles to the contrary, any provision of these Terms of Service that impose or contemplate continuing obligations or rights of a party will survive expiration or termination of these Terms of Service.

     12. DELIVERY FEE

Customer reverses the right to reject a delivery; however, delivery fee will be the responsibility of the customer, in particular orders which are made by the customer individually. 10ngah.com reserves the right to cancel delivery fee at any time. 10ngah.com gives customer upto three weeks to remit delivery fee to 10ngah.com, at which point we will formally start legal collection procedures to get collect the delivery fee. All charges associated with the collection of the delivery fees are the responsibility of the customer.

 13. EMERGENCY

In the event of a National Emergency or Disaster or a extended Lock-down mandated by Law please allow upto 7 days to get a reply from 10ngah.com or any number of days which may be announced by 10ngah via email, social media, push notification, print media or radio. 

14. 10ngah Return Policy

The following return policy applies to domestic orders only.

Our return policy strives to be as flexible as possible for our customer while allowing us to provide instant insider access to top designer labels and coveted products at a significant discount. As a result, not every product can be returned or returned for credit. To make the process easier for our valued members, we've broken down the details on what exactly is returnable and when you can expect to receive cash back or 10ngah.com credit. You can return the following items:

All sized items, which includes clothing, footwear, and belts unless the item is marked Final Sale or otherwise noted as non-returnable on the product page.

The following items are non-returnable:

All non-sized items, including handbags, ties, toys, and more are not eligible for return. Exceptions may apply so please check the individual product page carefully. The return availability status is also noted on each product in your cart at checkout within the terms and conditions.

Returns and Credits

10ngah.com allows you to return your product within 14 Days of Delivery. They will be a 35 percent levy against the original price. If product has been used refund will be in the form of 10ngah.com Credit and if product has significant wear and tear 10ngah.com reserves the right to refuse and return the product without any form of credit. If product has not been used refund will be in the form of the store credit minus the 35 percent restocking charge (If warranted 10ngah has the right to waive this restocking charge).

10ngah reserves the right to issue original form of payment refunds at its discretion. These refunds have a 35% restocking charge. 

Return executed in Zim Dollars and South African Dollars will be executed at the exchange rate which was valid at the time of purchase. 

10ngah Credits may be used on 10ngah.com and its affiliate 10ngah sites. 10ngah Credits may not be used to purchase Gift Cards.

10ngah Credits cannot be transferred to any other monetary form of payment or transferred to other users.

If the credit card used in connection with the purchase is expired or invalid, the refund will transfer over to your new card if it is with the same bank. If this is not possible, we will issue a check to the billing address on the credit card. If any promotional discount was applied to the total at the time of purchase, you will be refunded the actual amount paid at the time of purchase for that item. If you want to return an item received as a gift, you must contact customerservice@10ngah.com and you will receive your refund in 10ngah Credits.

Exchange Rate

Due to the global inflation crisis which started during the Covid Pandemic 10ngah reserves the right to immediately cancel your order in case of a significant change of the USD Exchange in relation to the Zimbabwean Dollar or South African Rand. If the foreign currency rate of the Zimbabwean Dollar or South African Dollar moves more than .075 percent on the official exchanges, 10ngah deems this to be significant enough to warrant an order cancellation. In addition, customers must immediately send us proof of payment after their order to help us manage foreign currency risk. Payments for orders must be done by 8PM on the same day of purchase and a Proof of Payment emailed to payments@10ngah or Whatsapp Message sent to +263 73 527 6570. 

Return or Exchange Eligibility Window

Eligible item(s) must be returned or exchanged within 14 days of the item shipped date or as otherwise stated on the item return policy. Returned items must be unused, unworn, unwashed and undamaged. Please return items in their original packaging, including: hangers, plastic wrap, hang tags on garments, shoeboxes, dust bags and gift boxes.

Delivery Fee

Customer reverses the right to reject a delivery; however, delivery fee will be the responsibility of the customer, particularly orders which are made by the customer individually. 10ngah.com reserves the right to cancel delivery fee at any time. 10ngah.com gives customer up to three weeks to remit delivery fee to 10ngah.com, at which point we will formally start legal collection procedures to get collect the delivery fee. All charges associated with the collection of the delivery fees are the responsibility of the customer.
